What is GDPR?

The General Data Protection Regulation (GDPR) (Regulation (EU) 2016/679) is a regulation by which the European Parliament, the Council of the European Union and the European Commission intend to strengthen and unify data protection for all individuals within the European Union (EU). The GDPR is effective as of the 25th of May 2018. Parkon Ltd. take data protection very seriously and we’ve developed a number of strict policies and procedures in line with the GDPR to ensure your data is handled safely and securely at all times.

 

Please read this policy carefully in full. You will also see a right of access section, a data subject should have the right of access to personal data which have been collected concerning him or her, and to exercise that right easily and at reasonable intervals. We operate under the General Data Protection Regulations as of 25th May 2018 along with the Data Protection Act 2018 (PDA).

 

What We do, how collect and process data

We manage and enforce the parking policies of privately owned car parks, private roadways and any other privately owned land that could be vulnerable to parking abuse on behalf of our clients and we achieve an effective management service through a number of methods including the use of the following.

 

Civil Enforcement Officers (CEOs) – The parking areas, car parks and sites managed by our CEO’s otherwise known as Patrol Officers are manually patrolled sites either by our own patrol personnel or directly enforced by our clients and their patrol personnel. All patrol personnel are trained to the highest standard in line with the IPC Code of Practice. When the patrol officers issue a Parking Charge Notice (PCN), as part of the process they will collect images of your vehicle, your vehicle registration number, make/model and colour of your vehicle. We may also obtain the details of the registered keeper of the vehicle from the Driver and Vehicle Licencing Agency (DVLA) and the information we receive may include the following;

  • The name and address of the registered keeper
  • The make, model and colour of the vehicle
  • Confirmation of the registration number
  • Any other information that we gather, in pursuance of the unpaid Parking Charge, including information that is shared by you with us.

 

Your data will be held for a sufficient time to enable the fee to be settled either by yourself or a third party and settle any outstanding charges or disputes. Your personal data will not be held for any longer than six years in such circumstances. In some circumstances, we may hold your data for longer than six years for the following purposes.

  • When there is an ongoing dispute which requires us to hold the data for longer than normal.
  • Where a court order has been made allowing us to pursue outstanding money after the expiration of six years.

 

Automatic Number Plate Recognition (ANPR) - We monitor the entry and exit of our privately managed ANPR car parks/sites ANPR Cameras. Images of vehicles including its surrounding and vehicle registration numbers will be captured to calculate the length of stay and enforce non-compliance of the terms and conditions of entry on to our privately managed car parks/sites.

 

The types of information we collect when an ANPR system is used are as follow.

 

T&C Compliant Parking - As a compliant user of our privately managed car parking site, the personal data we obtain is your registration number. The images we capture may include images of the vehicle including its occupants or bystanders. A full list of your Rights under GDPR are summarised further below. Where your data is obtained it will be retained for 3 months only. We then erase your registration and any other images from our records.

 

T&C Non-Compliant Parking - Where parking terms and compliance are not met, we may issue a payable Parking Charge Notice (PCN) and we may request personal details of the registered keeper of the vehicle from the DVLA and other third parties i.e. the registered keeper or hire companies where applicable, who may possess information which could assist in resolving any dispute.

 

The personal details we will obtain include:

  • The name and address of the registered keeper
  • The make, model and colour of the vehicle
  • Confirmation of the registration number
  • Any other information that we gather, in pursuance of the unpaid Parking Charge, including information that is shared by you with us.

 

Your data will be held for sufficient time to enable the fee to be settled, by you or another person, and resolve any dispute. However, your data will not normally be held for longer than six years in such circumstances. In some circumstances your data may be held for longer than six years. Examples of when we may hold your data for longer are;

  • When there is an ongoing dispute which requires us to hold the data for longer than normal.
  • Where a court order has been made allowing us to pursue outstanding money after the expiration of six years.

 

Appeals - If you decide to appeal a parking charge notice and we decline your appeal, then we will provide you with a unique reference number where you can further contest the PCN with an independent adjudicator known as Independent Appeals Service (IAS) and/or the IPC which was set up by the International Parking Community. In which case, we will share the case file with POPLA including personal data which may include the following;

  • The name and address of the registered keeper
  • The make, model, and colour of the vehicle
  • Confirmation of the registration number
  • Any other information that we gather, in pursuance of the unpaid Parking Charge, including information that is shared by you with us.

 

We may at times, also utilise wardens on our ANPR sites to effectively manage these privately-owned car parks. Our wardens will obtain manual images to gather evidence of any vehicles parked outside of the terms and conditions, these photos will include the vehicle registration number and may include people. If you breach the terms of parking, we will use this data to pursue the driver or keeper for outstanding parking charges.

Any personal data included in the images that is not relating to the breach, i.e. people or unrelated vehicle registration numbers will be censored.

Your GDPR Rights

Under the GDPR, you have the right to be informed, the rights of access, the right to rectification, the right to erasure, the right to restrict processing, the right to data portability and the right to object.

 

Note - We reserve the right to object to request if we do not agree with grounds of the request. On such occasion, we will advise you once the request has been made as to whether it will be accepted or not.

 

Right of Access

You have the right to submit a Right of Access request, and this can be done via an email request to our DPO. We may need to obtain proof of your identity before providing the information we hold on you.

Legitimate Interest to process personal data

The data processing element is necessary part of a contract agreement you have entered into by entering, parking or otherwise remaining on the privately owned/managed car parks or sites and there is a legitimate interest to do so. We are entitled to:

  • Pursue a motorist for an unpaid parking charge relating to a breach of contract.
  • Ensure safety and security and help deter/detect criminal activity.

 

Data Sharing

Your personal data may be shared for the payment of a parking tariff or charge with third parties i.e. payment facilitator, external software service provider, debt recovery agencies, solicitors, and high court officers/bailiffs where necessary to ensure compliance with your obligations under the contractual agreements.
